These Terms & Conditions govern your use of this website and any purchases made from Hey There Cherry Baby ("we", "us", "our").

Hey There Cherry Baby also trades as Cherrybaby and Cherry on Top Printables and publishes content through Cherry Pip.

By accessing our website or placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please do not use our website.

We sell gifts, home fragrance, home décor, stationery, accessories, digital printables, downloadable Canva templates and other lifestyle products through our online store.

2. Use of This Website

By using our website you agree to:

  • Use the website lawfully and responsibly.
  • Not copy, reproduce, scrape, distribute or misuse any part of the website without permission.
  • Not attempt to gain unauthorised access to our systems.
  • Not interfere with the operation or security of the website.
  • Not use the website to harass, abuse, defraud or otherwise harm our business or other users.

We reserve the right to suspend or restrict access where these Terms have been breached.

3. Products & Product Descriptions

We make every reasonable effort to ensure our product descriptions, photographs and specifications are accurate at the time they are published.

However:

  • Colours may vary slightly between screens, devices and printers.
  • Product images are intended as a guide and may differ slightly from the item received.
  • Handmade and small-batch products may vary slightly in appearance, colour, finish or texture.
  • Printed colours may differ between printers and paper types.
  • Supplier-manufactured products may occasionally vary slightly from published photographs due to manufacturing updates.

As our wax melts are hand-poured in small batches, slight variations in colour, finish and appearance may occur between batches. These natural variations do not affect the quality, fragrance or performance of the product and are not considered faults.

Likewise, due to the handcrafted nature of some products, minor imperfections or variations may be present. These form part of the character of handmade products and are not considered defects.

These natural variations do not affect your statutory rights.

4. Pricing & Payment

All prices are displayed in Pounds Sterling (£ GBP).

We are not currently VAT registered, therefore VAT is not charged on our products unless otherwise stated.

Prices may change without notice.

Payment methods may include:

  • Shopify Payments
  • PayPal
  • Klarna
  • Apple Pay
  • Google Pay

Payments are processed securely by our payment providers.

We do not store or have access to your full payment card details.

Orders are only accepted once payment has been successfully authorised.

We reserve the right to correct genuine pricing errors before accepting an order. If this happens, we will contact you before processing your order.

5. Order Processing

Physical products are dispatched either:

  • Directly by us from our UK studio; or
  • By carefully selected UK fulfillment partners where appropriate.

Some orders containing multiple products may arrive in separate parcels.

You will not be charged additional delivery costs where this occurs.

Digital products, including printable downloads and Canva templates, are generally made available immediately following successful payment, although occasional delays outside our control may occur.

We reserve the right to refuse or cancel an order where:

  • Fraud is suspected.
  • Payment cannot be authorised.
  • A product becomes unavailable.
  • An obvious pricing or listing error has occurred.
  • We reasonably believe an order has been placed in breach of these Terms.

If we cancel an order before dispatch, any payment received will be refunded in full.

6. Product Availability

While we make every effort to keep our website accurate and up to date, product availability cannot always be guaranteed.

We reserve the right to:

  • Withdraw products from sale.
  • Discontinue products without notice.
  • Amend product specifications.
  • Update packaging or product presentation.
  • Limit purchase quantities where necessary.

These changes may occur without prior notice.

7. Delivery

Estimated delivery timeframes are provided within our Shipping Policy and during checkout.

Whilst we aim to dispatch and deliver orders promptly, delivery times are estimates only.

Delays may occasionally occur due to circumstances beyond our reasonable control, including:

  • Postal or courier delays
  • Industrial action
  • Severe weather
  • Public holidays
  • Supplier delays
  • High seasonal demand

We cannot accept responsibility for delays once an order has been passed to the relevant delivery provider.

Risk in physical goods passes to you once your order has been delivered to the delivery address provided at checkout.

8. Wax Melt Safety & Usage

Our wax melts are intended solely for household fragrance use.

They should only be used:

  • In a suitable ceramic wax burner with an unscented tealight; or
  • In an electric wax warmer specifically designed for wax melts.

Always:

  • Read and follow the safety information provided on the product packaging.
  • Keep away from children and pets.
  • Keep away from food, drink and animal feed.
  • Never leave a burner unattended while in use.
  • Keep away from flammable materials.
  • Do not ingest.
  • Do not apply directly to skin.

Failure to follow the supplied safety instructions may result in damage or injury for which we cannot accept responsibility.

9. Returns, Refunds & Consumer Rights

Our Returns Policy forms part of these Terms & Conditions and should be read before placing an order.

In summary:

  • Wax melts are non-returnable unless faulty, damaged or supplied incorrectly.
  • Digital downloads and digital products are non-refundable once access or download has been provided, except where required by law.
  • Home décor and accessories may be returned within 14 days of receipt, provided they are unused, in their original condition and suitable for resale.
  • Damaged or incorrect items should be reported within 2 working days of delivery, together with photographs where appropriate.
  • Unless an item is faulty or supplied incorrectly, return postage costs remain the responsibility of the customer.

Where products have been personalised, customised or created specifically to your requirements (including personalised or customised wedding stationery), your right to cancel may not apply unless the item is faulty or not as described.

Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

10. Digital Downloads & Canva Templates

Our digital products are supplied for personal use only, unless explicitly stated otherwise.

This includes printable products, downloadable files and editable Canva templates.

You may:

  • Print products for your own personal use.
  • Use templates for your own event, celebration or classroom where permitted.
  • Edit Canva templates for your own personal requirements.

You may not:

  • Resell digital files.
  • Resell printed copies.
  • Share files with others.
  • Upload files to file-sharing websites.
  • Upload files to online marketplaces.
  • Redistribute templates.
  • Claim our designs as your own.
  • Use our designs for commercial production or resale without written permission.

Some editable products are supplied using Canva.

Use of Canva templates is also subject to Canva's own Terms of Use, which are independent of these Terms & Conditions.

Purchasing a digital product grants a licence for permitted use only and does not transfer ownership of the underlying artwork, template or design.

11. Intellectual Property

All content published on this website remains the intellectual property of Hey There Cherry Baby unless otherwise stated.

This includes, but is not limited to:

  • Logos
  • Product photographs
  • Product descriptions
  • Website copy
  • Branding
  • Printable designs
  • Canva templates
  • Graphics
  • Illustrations
  • Digital artwork

You may not:

  • Copy or reproduce our content.
  • Redistribute our digital products.
  • Remove copyright notices.
  • Use our branding without permission.
  • Train artificial intelligence models using our artwork, designs, photography or written content without our prior written consent.

Unauthorised use may result in legal action.

12. Liability

We supply our products with reasonable care and skill.

We cannot accept liability for:

  • Misuse of products.
  • Failure to follow supplied safety instructions.
  • Damage or injury resulting from improper use.
  • Allergic reactions where ingredients have been clearly declared.
  • Delays caused by postal services or courier companies outside our control.
  • Indirect or consequential losses arising from use of our products.

Our total liability for any claim relating to a purchase shall not exceed the amount paid for the relevant product.

Nothing within these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or any statutory consumer rights that cannot legally be excluded.

13. Promotional Codes & Discounts

From time to time we may offer promotional discounts or discount codes.

Unless otherwise stated:

  • Promotions cannot be applied retrospectively.
  • Promotions cannot normally be combined.
  • Promotions may be amended or withdrawn without notice.
  • Discount codes have no cash value.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where this results from circumstances beyond our reasonable control.

Examples include:

  • Extreme weather
  • Flood
  • Fire
  • Industrial action
  • Postal disruption
  • Supplier failure
  • Cyber incidents
  • Government restrictions
  • Power failures
  • Other unforeseen events

Where possible, we will keep customers informed and fulfill orders as soon as reasonably practicable.

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may amend these Terms & Conditions from time to time to reflect changes to our business, products, legal requirements or website.
